The problem of ruju' arises when it relates to the question of whether an act of intercourse between a husband and wife who are divorced within the period of 'iddah is deemed as ruju' or otherwise. Several Syariah Court cases indicate that the court is certain as to the principles in the mazhab of Shafi'i that such an act is not deemed as ruju' unless ruju' has been uttered or pronounced prior to that act. Emphasis by the Syariah Court in the application of the principles of mazhab Shafi'i in matters pertaining to ruju' bi al-fi'li has in some way caused problems in the community. As such this article reviews the situation of ruju' from the perspective of Islamic law and its implementation according to Islamic family laws in Malaysia.
Illegitimate child refers to a child conceived during sexual intercourse outside of wedlock. The jurists have different views regarding the gestation period of pregnancy that affects the legitimacy status of the child. The objective of this article is to analyze the different views of the jurists regarding the status as well as rights of the illegitimate child in Islam and current religious ruling implemented in Malaysia. This article also analyzes the rights of the illegitimate child towards a personal identity that involved lineage that effects on how his/her name and surname will be stated on birth certificate according to the Islamic and civil law in Malaysia. Issues on custody, maintenance, marriage guardianship of the illegitimate child and his / her relation with biological father that married to his / her mother will also be discussed according to the opinions of the jurists as well as Islamic family law in Malaysia. This study utilized content analysis method on discussions put forward by the jurists in authoritative jurisprudence books as well as contemporary jurisprudence books and law provisions that are provided in Islamic and civil law implemented in Malaysia to date. The findings show that Islamic family law protects rights of the illegitimate child in terms of self-identity (lineage), custody, maintenance and marriage guardianship. However, the issue regarding the surname of the illegitimate child was raised in Civil Court, arguing that he/she should be allowed to be named to his/her biological father who had married the mother. This issue needs to be scrutinized. The amendment should be carried out so that matters related to the Muslims' personal laws are implemented according to the Islamic law.
In Islam, it is very important to the judges to determine the amount of maintenance for the wife and child that is in line with the meaning of kifayah and makruf. This article aims to study cases decided by the judges at the Malaysian Syariah court relating to maintenance for the wife and children. The study attempts to examine the factors considered by the judges in determining the amount of maintenance for the wife and child in order to comply with the meaning of kifayah and ma’ruf. Data were collected from the cases issued by the Shariah Court in Malaysia. This research found that the judges consider several factors in determining the rate of nafkah for the wife and child based on their own judgment. Consequently, in the long run, it will differentiate the judgement made by the judges from one case to another according to their individual experience. Among the factors take into consideration by the judges are: ability of the maintenance provider, financial need by the plaintiff, i.e., ex wife and child, essential expenses and the socio economic status of the wife.

Among of them are those whom still bound to talaq raj'i iddah waiting period. A marriage that overrule this term is fasid marriage and is not legal. This article is to focus debates among Moslem scholars related to dissolution of marriage of a couple in Syariah High Court, Kuala Terengganu. Reason being is that to marry Muslim woman that is still bound to talaq raj'i iddah waiting period is not allowed. Special focus on judgement done by Chief Judge, State Syariah Court of Terengganu, in regard to Nor Radhiah Bin Ramli vs Aziz Bin Osman case. The dissolution of marriage by Syariah Hight Court is base on existing enactment which follows al-Shafi'i path. This article discusses rights of access and the issue of denying access to a parent or party with an access order as well as a parent's refusal to hand over the children to the party with a custody order. In some cases, it has even led to the abduction of children by the party whose access was denied. Denying a parent the right of access to his/her children is not only an act of breaching the law but also an act of committing sin to the denied parent as well as to the children. In fact, for their emotional and physical well-being, children are entitled to continue their relationship with both parents.
